By downloading, installing, or using Inkwell ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use Inkwell for personal purposes, subject to these Terms.

You May:

• Create and manage handwritten notes
• Draw and sketch using various pen styles
• Organize notes into folders
• Record audio while taking notes
• Create time-lapse recordings of your drawings
• Export notes as PDF
• Use multiple page templates
• Backup and restore your data

You May NOT:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use the App for illegal purposes
• Attempt to hack or compromise the App's security
• Resell the App or its features
• Use automated systems to access the App
• Circumvent premium feature restrictions

3. Free vs. Pro Features

3.1 Free Features

The free version of Inkwell includes:

• Up to 10 notes
• Up to 3 pages per note
• Up to 5 minutes of audio recording per note
• 1 time-lapse recording
• 2 pen styles (Basic, Fine Liner)
• 4 background templates (Blank, Lined, Grid, Dotted)
• Folder organization
• Palm rejection support
• Apple Pencil support
• Dark mode support
• 9 languages supported

3.2 Pro Features (One-Time Purchase)

Pro users get:

• Unlimited notes
• Unlimited pages per note
• Unlimited audio recording duration
• Audio playback synchronized with your drawings
• Multi-page PDF export
• Unlimited time-lapse recordings
• 8 premium pen styles (Brush, Calligraphy, Fountain, Marker, Pencil, Crayon, Watercolor, Neon)
• 11 premium templates (Small Grid, Isometric, Cornell, Music, Calligraphy, Seyes, Hexagon, Storyboard, Planner, Graph, Polar)
• All future premium features included

4. In-App Purchase Terms

4.1 Purchase Option

• Inkwell Pro: One-time purchase for permanent Pro access

4.2 Purchase Terms

• This is a one-time purchase, NOT a subscription
• Pro purchase is permanent and does not expire
• No automatic renewals or recurring charges
• Purchases are tied to your Apple ID
• You can restore purchases on other devices using the same Apple ID
• Pro access works on all your devices (iPhone and iPad) with the same Apple ID

4.3 Refund Policy

• All purchases are processed by Apple and are final
• Refunds are handled by Apple according to their policies
• To request a refund, contact Apple Support: https://support.apple.com
• We cannot process refunds directly

5. Your Content and Data

5.1 Ownership of Data

You retain full ownership of all content you create using Inkwell, including:

• Handwritten notes and drawings
• Audio recordings
• Time-lapse videos
• Folders and organization
• Exported PDF files

We do NOT claim any rights to your content. Your notes are private and belong entirely to you.

5.2 Content Responsibility

You are solely responsible for the content you create in Inkwell. While your notes are private, you agree not to use the App to store:

• Illegal content
• Content that violates others' rights
• Malicious files or code

6. Privacy and Data Storage

Inkwell is designed with privacy as a priority:

• Local Storage: All data is stored locally on your device
• No Third-Party Servers: We do NOT upload your notes to our servers
• No Account Required: The app does not require login or account creation
• No Data Collection: We do not read, access, or collect your note content
• Your Control: You can delete all data at any time

7. Permissions

Inkwell may request the following permissions:

• Microphone: To record audio while taking notes
• Photo Library: To save exported images and PDFs
• Notifications: For background recording status
• Face ID / Touch ID: Optional app lock for privacy

All permissions are optional. You can manage these permissions in iOS Settings at any time. The app functions without granting these permissions, though some features may be limited.

You agree NOT to use Inkwell for:

• Any illegal activities or purposes
• Storing illegal, harmful, or offensive content
• Attempting to circumvent Pro feature restrictions
• Interfering with the App's functionality
• Any purpose that violates applicable laws or regulations

10. Third-Party Services

Inkwell integrates with:

• Apple App Store: For app distribution and in-app purchases
• Apple StoreKit: For purchase management and verification
• Apple Local Authentication: For Face ID / Touch ID support

Your use of these services is subject to their respective terms and privacy policies.

11. Disclaimer of Warranties

Inkwell is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Uninterrupted or error-free operation
• Data preservation or backup

12. Limitation of Liability

To the maximum extent permitted by law:

• We are NOT liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for in-app purchases (if any)
• We are not responsible for loss of notes or data
• We are not responsible for device malfunction or iOS system errors
• We are not responsible for audio recording failures

13. Changes to Terms

We may modify these Terms at any time. We will notify you by:

• Updating the "Last Updated" date
• Posting the new Terms at this URL
• In-app notification for significant changes

Continued use of the App after changes constitutes acceptance of the new Terms.

14. Termination

We may suspend or terminate your access to Inkwell if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the App or its features
• Use the App for illegal purposes

You may terminate your use at any time by uninstalling the App. Your local data will be deleted upon uninstallation unless backed up.

15. Governing Law

These Terms are governed by the laws of South Korea, without regard to conflict of law principles. Any disputes shall be resolved in the courts of South Korea.
